According to information gathered by The New Daily Prime on Wednesday, August 25, 2024, an Area Court at Center-Igboro in Ilorin dissolved the Islamic marriage between Toyin Ajibola and Bashirat Mohammed due to the husband’s financial incapability.
The presiding judge, Hammad Ajumobi, while delivering the judgment, noted that although Mr. Ajibola was unwilling to let go of his wife, she needed to find a means of survival and could not be left abandoned.
The judge accordingly dissolved the marriage and granted guardianship of the three children to the wife.
The court also mandated that the wife observe a three-month iddah (waiting period) before she could remarry.
Judge Ajumobi further instructed Mr. Ajibola to take responsibility for providing for the children to the best of his ability.
“He should have unrestricted access to the children, and the mother must make them available whenever the father requests,” the judge ordered.
Earlier, Bashirat Mohammed had requested a divorce, expressing her dissatisfaction with the marriage, citing financial struggles and her husband’s irresponsibility.
“I want the court to grant me a divorce so I can have peace of mind,” she pleaded.
However, Mr. Ajibola appealed to the court, stating that he did not want his wife and children to leave him, even though he was unable to adequately provide for them.
“I have been trying hard to get money to feed my family, but I couldn’t,” he said. The rate of marriage dissolution in Nigeria is relatively lower compared to Western countries, but the trend is increasing, especially in urban areas where societal views are more progressive.
