The Office of former Attorney General of the Federation and Minister of Justice, Abubakar Malami, SAN, has accused the Economic and Financial Crimes Commission (EFCC) of openly defying a valid court order, illegally detaining Malami beyond the period allowed by law, and subjecting him to what it described as a “trial by media.”
In a statement issued on Wednesday by Mohammed Bello Doka, special assistant on Media to Malami, said the EFCC refused to comply with a High Court of the Federal Capital Territory (FCT), Abuja, order granted on December 23, 2025, which admitted Malami to bail on conditions already fulfilled.

Malami accuses EFCC of raiding his house
According to the statement, EFCC officials allegedly rejected service of the court order, chased away the court bailiff, and insisted on keeping Malami in custody in what the office described as a “brazen and contemptuous” violation of the rule of law.
The office further alleged that the former Attorney General of the Federation has been detained for more than 14 days without being arraigned before any court of competent jurisdiction, despite the existence of a separate court order that permitted his detention for only a maximum of 14 days, which it said expired on Tuesday.
It maintained that even without reference to the bail granted by another High Court, the EFCC was legally required to either release the ex-minister immediately or arraign him before a court, actions it claimed the commission failed to take.
The statement also accused the anti-graft agency of engaging in an orchestrated media campaign by feeding selective information to the press in an attempt to prejudice public opinion against Malami, rather than subjecting the allegations to judicial determination.
Describing the EFCC’s conduct as a dangerous abuse of power, the office warned that disobedience to court orders by a statutory agency poses a serious threat to democracy and the constitutional order.
The office called on the judiciary to take urgent notice of the alleged contempt, urged relevant oversight bodies to hold the EFCC accountable, and appealed to Nigerians to speak out against what it described as a dangerous precedent.
“No agency, no matter how powerful, is above the law,” the statement concluded.
