The Attorney-General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, has clarified that no inmate granted clemency under the recent exercise of the President’s power of prerogative of mercy has been released from correctional custody.
In a statement he personally signed, Fagbemi explained that the process is currently in its final administrative stage, which involves a standard review.

He said this step is necessary to ensure all names and recommendations are in complete compliance with established legal and procedural requirements before any official instrument of release is issued.
According to him, the ultimate phase of the exercise, following approval by the Council of State, is the issuance of the instrument for implementing the decision for each beneficiary.
This stage, Fagbemi said, serves as an opportunity for a final verification of the list for any necessary remedial purposes before the instrument is sent to the Controller-General of Corrections for action.
Fagbemi emphasised that this verification is part of the standard protocol, reflecting the government’s dedication to transparency and due diligence.
Addressing concerns about a potential delay, he noted: “There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy.”
He added that the rule of law requires meticulous action, not haste, to ensure fairness.
Fagbemi also thanked the public for their vigilance and constructive feedback, which he said helps strengthen institutional integrity, demonstrating the deep concern Nigerians have for justice and good governance.

“The public will be duly informed once all legal and procedural checks have been concluded”, he said.
